Acceptable Use Policy
§ 1 Purpose and scope
This Acceptable Use Policy (“AUP”) defines the rules and boundaries for the use of all services provided by Sitequest e.K. (“Sitequest”, “we”, “us”). This AUP applies to all customers, users, and anyone accessing or using our services, including virtual private servers (VPS), domain registrations, and related hosting services.
This AUP is incorporated into and forms part of our Terms of Service. Violations of this AUP may result in warnings, service suspension, or account termination.
As a reseller of infrastructure and domain services, we are bound by the terms of our upstream providers. You are therefore also subject to the applicable conditions of our partners, in particular 24fire GmbH (hosting infrastructure) and Hosting Concepts B.V. / Openprovider (domain registration). This AUP reflects and incorporates the obligations arising from those relationships.
§ 2 General obligations
You agree to:
- Use the Services exclusively in compliance with all applicable local, national, EU, and international laws and regulations.
- Respect the rights, privacy, and intellectual property of others.
- Maintain accurate and current contact information in your account at all times.
- Take reasonable security measures to protect your servers and applications from unauthorized access and misuse.
- Respond promptly to any abuse notification from Sitequest.
§ 3 Prohibited content
You may not use the Services to store, distribute, transmit, or make accessible any content that:
- Is illegal under the laws of the Federal Republic of Germany, the European Union, or the laws applicable in your jurisdiction.
- Constitutes, promotes, or facilitates child sexual abuse material (CSAM) in any form. We operate a zero-tolerance policy and will immediately report any such content to the competent authorities.
- Constitutes terrorist content within the meaning of Regulation (EU) 2021/784 (TCO Regulation). See our TCO page for further information.
- Incites violence, hatred, or discrimination against persons or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics.
- Infringes on copyrights, trademarks, patents, trade secrets, or other intellectual property rights of third parties.
- Constitutes defamation, libel, or unlawful threats.
- Contains or distributes malware, viruses, trojans, ransomware, spyware, or any other malicious software.
- Promotes or facilitates illegal gambling, unlicensed pharmaceutical sales, controlled substances, weapons trafficking, or other illegal products or services.
- Violates export control laws or sanctions regulations, including EU and US sanctions programs.
§ 4 Prohibited activities
You may not use the Services to engage in or facilitate any of the following activities:
4.1 Network abuse
- Sending unsolicited bulk email or messages (spam), whether commercial or otherwise.
- Operating open mail relays, open proxies, or open DNS resolvers.
- Conducting Distributed Denial of Service (DDoS) attacks or participating in botnets.
- Port scanning, network probing, or vulnerability scanning of systems you do not own or have explicit authorization to test.
- IP address spoofing or forging packet headers.
- Intercepting, monitoring, or eavesdropping on network traffic not intended for you.
4.2 DNS abuse
In accordance with ICANN regulations and our upstream registrar's policies, the following activities related to domain names are strictly prohibited:
- Phishing: Using domain names or DNS records to create deceptive websites or services that impersonate legitimate entities to steal credentials, personal data, or financial information.
- Pharming: Redirecting users from legitimate websites to fraudulent ones through DNS manipulation.
- Malware distribution: Using domain names to host, distribute, or control malware, including command-and-control (C2) servers.
- Botnet operation: Using domain names as part of botnet infrastructure (e.g. DGA domains, fast-flux DNS).
- Domain name fraud: Registering domains using false or stolen identity information, or engaging in cybersquatting or typosquatting.
4.3 Resource abuse
- Cryptocurrency mining or any computational workload designed to generate cryptocurrency, tokens, or similar digital assets, unless explicitly permitted under a dedicated plan.
- Running processes or applications that consume excessive shared resources (CPU, RAM, bandwidth, I/O) in a manner that impacts other customers.
- Using the Services for TOR exit nodes without prior written approval.
- Reselling, subletting, or redistributing the Services to third parties without our prior written consent.
4.4 Unauthorized access
- Attempting to gain unauthorized access to any system, network, account, or data, including our infrastructure and other customers' services (hacking, brute-forcing, privilege escalation).
- Exploiting security vulnerabilities in software or systems without authorization from the system owner.
- Circumventing or attempting to circumvent security measures, access controls, or usage limits imposed by Sitequest.
§ 5 EU regulatory compliance
We comply with the following EU regulations and you must cooperate with us in fulfilling our obligations under these regulations:
- Digital Services Act (EU) 2022/2065 — We act as a hosting service provider. We have designated a point of contact for authorities and users to report illegal content. See our DSA page.
- Regulation (EU) 2021/784 (TCO) — We are obligated to remove terrorist content within one hour of receiving a removal order from a competent authority. See our TCO page.
- General Data Protection Regulation (EU) 2016/679 — If you process personal data of EU residents through our Services, you must do so in compliance with the GDPR.
You acknowledge that we may be required by law to remove or restrict access to content, or to disclose information to competent authorities. We will act in accordance with applicable law and, where legally permitted, will notify you of such actions.
§ 6 Reporting abuse
If you become aware of any content or activity that violates this AUP, please report it to:

Reports should include:
- A clear description of the content or activity.
- The IP address, domain name, or URL involved.
- Any supporting evidence (screenshots, headers, logs).
- Your contact information.
We review all abuse reports and respond in a timely manner. For specific reporting procedures, see also our DSA, TCO, and DMCA pages.
§ 7 Consequences of violations
We reserve the right to take any of the following actions in response to a violation of this AUP, depending on the severity, nature, and frequency of the violation:
- Warning — A written notice requesting immediate cessation of the violation and remediation.
- Content removal — Removal of or restriction of access to the offending content.
- Service suspension — Temporary suspension of part or all of your Services.
- Account termination — Permanent termination of your Account and all associated Services, without refund.
- Law enforcement referral — Reporting the violation to the relevant law enforcement or regulatory authorities.
In cases involving illegal content (particularly CSAM, terrorist content, or criminal activity), we may bypass warnings and immediately suspend services and notify authorities.
Suspension or termination for AUP violations does not entitle you to a refund. You remain liable for any damages caused to us or third parties by your violation of this AUP.
§ 8 Monitoring and investigation
We do not proactively monitor the content stored on or transmitted through our Services. However, we reserve the right to investigate suspected AUP violations and to cooperate with law enforcement authorities and court orders.
We may monitor traffic patterns and system metrics for the purpose of detecting network abuse, DDoS attacks, or other threats to our infrastructure. This does not extend to monitoring the substance of customer data.
§ 9 Changes to this policy
We may update this AUP at any time. Material changes will be communicated at least 30 days in advance via email or through the Platform. Continued use of the Services after the changes take effect constitutes acceptance of the updated AUP.
